In Favor :-

  • Harassing people violently deserves barbaric punishments. Victims should have the right to take revenge for their suffering.
  • Torture can act as a deterrent. Rapists will be afraid of the consequences before committing the crime. This will reduce the number of crimes.
  • Criminal will feel the pain of the victim, if he is subjected to the same kind of harassment. Thereby, he may not commit the crime again in his life.

Against :-

  • Throughout India, many false rape cases are being registered these days. Torturing all of the accused persons causes torture to innocent persons too.
  • We are living in a civilized society. World is preferring humane ways to deal with everyone including criminals. We should not stoop to the criminal’s level by torturing him/her in inhumane ways.
  • The aim of prisons is to reform the criminals. By torturing him, we’ll have no chance to reform the person, instead the criminal may become more dangerous once he is out of jail.

Situation in India :-

  • Till 2013, punishment for rape was just seven years.
  • With the introduction of ‘Anti-rape law‘ in 2013, punishment for rape is extended to life imprisonment and even death sentence in the cases of heinous crimes.
  • Conviction rate for rape is very low in India even after the Nirbhaya incident. This is because of the many loopholes in India’s judicial system. Another reason is that Indian judiciary’s stance is that “no innocent person should be punished“.

Conclusion :-

Our justice system is still imperfect. There are many cases, where innocent persons are suffering in prisons for the crimes they have not committed, and the real criminals are escaping the judicial system. In this situation, we cannot outright torture the accused.

However, if the accused is the real culprit, he/she deserves harsher punishments. Rapists are non-reformable in general. Murderers can more likely be reformed than rapists. As we are living in a civilized society, laws and intellectuals do not agree for barbaric punishments. So, imposing life sentence can serve the purpose of protecting society from the dangerous criminals.

    Rapists and murders SHOULD definitely be tortured to death. Why should they get humane treatments when they are doing something so barbaric? Those people will take away what’s important to the innocent victims, and the victims have to live with the trauma and pain for life, sometimes getting shunned. Why should we even let people like that live? Let alone releasing them back into society after what they’ve done? They’ve taken the victims’ bodies and sometimes even their lives against their wills, they should not have the right to exist anymore, just give them what they deserve instead of the law protecting them! The only reason why this kind of punishment shouldn’t be carried out is because the accused could be innocent and we don’t want to punish people who’s done nothing wrong, besides that, I’m all for it. If you disagree, you are either stupidly kind hearted or a rapist/murderer yourself.

    I run a support group for abused women in the UK, and this is one of the most talked about topics in our group discussions.
    We fully accept that there are different types of rape; statutory rape between young lovers or rape within a marriage should generally be judged individually and the sentencing imposed accordingly. Violent rape by strangers and serial rapists are much more serious and the punishment has to be an effective deterrent.
    We do not condone castration for two reasons: firstly, testosterone replacement therapy is readily available on the internet meaning that any castrated man can easily retain his virility. Secondly, attacking the testicles is generally the most effective way for a woman to defend herself against a bigger, stronger man. Potentially violent men should retain that area of vulnerability in our opinion.
    The most popular solution seems to be that the rapist should undergo a minor operation, easily performed in 30 minutes via microsurgery. Close to the prostate there is a branch of nerves to the penis which control the process of erection, and sensation to the penis. These should be severed, leaving him with a permanently numb & flaccid penis. Severing the penis would, we believe, be cruel & unnecessary, although this could be reserved for men who go on the inflict further abuse on women.
    The above treatment should be in addition to a prison term in proportion to the severity of the attack ie. the trauma suffered by the victim and, as an extra deterrent, the word “rapist” should be tattooed on their forehead.
    We believe this to be a just punishment which includes an element of revenge which many victims wish for.

    Once the individual is confirmed as accused
    First thing we must to study them psychologically (know how they feel before committing the crime, their thought processs,lifestyle and kinds of habits which influenced them to commit).
    Later victim/victims families must be given freedom to chooses whether to torture them /kill them/forgive………
